Granger appeals Chief Justice Chang’s decision

DavidGranger_300x0Georgetown : Leader of the Opposition David Granger, through his Attorney Mr. Basil Williamsyesterday an appeal in the Supreme Court of Judicature against the court’s ruling to exclude David Granger from the Budget cut case; that the Full Court lacked Jurisdiction.

 

The grounds for appeal state that the Full Court of Appeal comprising the Honourable Justice James Bovell-Drakes and the Honourable Justice Rishi Persaud erred in law and misdirected themselves in holding that the Full Court lacked jurisdiction to hear and determine the appeal instituted by way of Notice of Appeal No. 44/Apl. Of 2013, against the order of Chief Justice Ian Chang made on the 19th June 2013, in action No. 216 of 2012, Demerara. It further states that the Full Court of Appeal erred in law and misdirected itself when it failed to appreciate the legal principles which determine whether the decision of a Judge of the High Court was final or interlocutory. That the Full Court erred in law and misdirected itself when it failed to appreciate that the decision of the learned Chief Justice Ian Chang was interlocutory and not final.
